Article 1 Scope
These terms apply to all participants (individuals and teams) in the Night of the Refugee 2022. The terms are published on www.nachtvandevluchteling.nl (hereinafter: Website).
Article 2 Night of the Refugee
The Night of the Refugee is organised by the Refugee Foundation (hereinafter: Organisation), located at Laan van Nieuw Oost-Indië 131 in The Hague (2592 BM).
The Night of the Refugee is an annual sponsored run. Participants run a route of 10, 20 or 40 kilometres during the Night of the Refugee, usually in June. The primary purpose is to draw attention to refugees. The secondary purpose is to raise money for the Refugee Foundation. There are various starting and finishing lines in the Netherlands. Further information is available on the Website.
Article 3 COVID-19
The Organisation would like the Night of the Refugee 2022 to continue, but in a responsible and safe way. This means that the Night of the Refugee 2021 will be organised differently than usual due to corona. Depending on the corona developments, the number of routes may be adjusted, distances may be altered, the maximum number of participants (per route or not) may be changed and additional rules for participants may apply. Should this not be sufficient to comply with all rules and/or to ensure the safety of the participants, the Organisation may yet decide to move or cancel the Night of the Refugee 2022. The Website will always contain the latest information.
Article 4 Participation
You can participate as an individual or as a team. All participants in the Night of the Refugee must be in possession of a valid participation certificate.
Participants must register with the Organisation for a participation certificate. Registration takes place through the Website. The Website also provides the registration deadlines and any additional conditions (e.g. minimum age, maximum number of participants, etc.). Only complete and correct registrations will be accepted. If an entry is approved, the participant will receive a provisional participation certificate. This provisional participation certificate will be converted into a definitive participation certificate as soon as the financial commitments have been met.
If the maximum number of participants is reached, the Organisation will inform the persons concerned and put them on a reserve list. In the event of cancellation and/or increase of the number of participants, they will be the first to be invited to reregister.
Article 5 Personal data
Participants will be asked for various pieces of personal data on the Website. The Organisation needs these data in order to properly organise the Night of the Refugee 2022.
The personal data will only be used for the Organisation of the Night of the Refugee 2022, unless Participants explicitly indicate that their data may also be used for (the promotion of) other activities of the Refugee Foundation. In that case, the first name, surname and email address will be stored in the administration of the Refugee Foundation in order to send email messages about future activities of the Refugee Foundation.
Participants are aware and agree that their first name and/or surname, whether or not in combination with the competition results, will be made public by the Organisation.
All personal data will be processed in accordance with the Privacy Statement of the Refugee Foundation, published on www.nachtvandevluchteling.nl/privacy.
Participants may be photographed and/or filmed during the Night of the Refugee. If a participant does not want this, he/she must make this known immediately. If a participant does not specifically object, he/she gives permission to the Organisation to use the recordings in the context of media attention, publicity, promotion and/or the organisation of the Refugee Foundation in general and the Night of the Refugee in particular.
Article 6 Financial
Each participant must find sponsors to contribute financially to their participation in the Night of the Refugee. This process is conducted through the Website; sponsors can donate money through the Website to the participant of their choice. A participant can also donate money themselves.
The proceeds of the Night of the Refugee go entirely to the Refugee Foundation. The exact allocation will be decided by the Refugee Foundation in its sole discretion.
Each individual participant must achieve a minimum sponsorship income. For the 40 KM route this is €250,- and for the 20 KM route this is €100,-. Each team must achieve a minimum sponsorship income of €250,- or 100,- per team member. This minimum target amount must be reached no later than June 10th 2022. If it is not reached, the provisional participation certificate will expire and no definitive participation certificate will be issued. The sponsor proceeds already received at that time will not be refunded and will simply go to the charity: the Refugee Foundation.
If the Night of the Refugee 2022 cannot be held due to force majeure, the sponsor proceeds will simply go to the charity: the Refugee Foundation.
Article 7 Force majeure
The Organisation will make every effort to allow the Night of the Refugee 2022 to take place, but cannot guarantee this as it is partly dependent on external factors, such as, but not limited to: corona, weather conditions, security, government measures, etc. If the Night of the Refugee 2021 cannot take place due to external factors, this will constitute a case of force majeure.
The Organisation may decide not to organise the Night of the Refugee 2022 due to force majeure. In that case, the 2022 Night will be cancelled and the 2023 Night will resume next year.
The Organisation may decide to cancel the already planned Night of the Refugee 2022 on a specific date due to force majeure. In that case, the Organisation will decide whether the 2022 Night will be moved to another date or cancelled altogether.
Article 8 Run route
The Night of the Refugee consists of one or more run routes to be completed in the evening and/or at night. There is no element of competition about the routes.
Participants in the Night of the Refugee realise that they will have to make mental and physical efforts during the run. They will need to provide the necessary equipment, prepare themselves properly and check that they are mentally and physically fit enough before the actual start.
During the Night of the Refugee, participants must register on time, correctly and with a valid participation certificate and must always immediately follow the route and instructions given by the Organisation, as well as any additions to them.
During the run, participants are required to behave in a sporting manner, not to cause any nuisance or danger, not to behave in an offensive or indecent manner and to abide by the law and the instructions of the competent authority.
Article 9 Liability
Participants take part in the Night of the Refugee voluntarily and at their own risk and expense. Each participant is aware that due to the mental and physical efforts and the fact that these have to be made during the evening/night, there are risks involved in their participation. Each participant is responsible for his/her own personal belongings.
The Organisation will make every effort to ensure that Night of the Refugee takes place in a correct and safe manner. No further guarantee is given by the Organisation.
The liability of the Organisation is limited to the amount paid out by its event insurance for the Night of the Refugee 2022, plus its own risk. If a loss, for whatever reason, is not covered, the Organisation will only be liable if it is due to intent or gross negligence on the part of the Organisation.
If a participant acts contrary to the provisions of these terms, this participant will be liable for any loss sustained by the Organisation as a result. In addition, the Organisation is entitled to exclude this participant from (further) participation in the Night of the Refugee.
Article 10 Final provisions
These terms also apply to the Terms of Sponsorship of the Night of the Refugee 2022. In the event of contradiction, the Terms of Sponsorship will take precedence.
In all cases not provided for in these terms, the Organisation will decide.
Dutch law applies to these terms. Disputes arising from these terms and/or the Night of the Refugee must be referred to the competent court in The Hague.
The Organisation will have the right to unilaterally modify these terms within reasonable limits for good cause.
